Open Question: florida buyer in escrow refused to close the transaction. what can I do?

I have a buyer who is currently in escrow on a short sale. he has said verbally that he was not going to complete the purchase. there is a 14 day extension in place so we are locked for 14 more days. now I have a backup offer that wants to close on the property immediately. the orig buyer has been unresponsive to calls from my agent and the title company. is there a form we can send to the orig buyer giving x number of days to complete or cure the problem? the property is in florida. what happens to the earnest deposit? am I entitled to that? please only those familar with Florida Real Estate should reply more

Open Question: Renting without a lease agreement and landlord is heading for foreclosure. How can I get my deposit back?

My lease agreement ran out a year ago. After the twelfth month, I continued to pay my rent as per the guidance of the real estate agent that found this house for me. As I have been hoping to purchase a home in the near future, I didn't mind having a month-to-month agreement, but I am still probably 9 months out. I have just began receiving letters stating "It's not too late to save your home" as well as attorney letters from the home owners association. I provided the landlord with first month plus one month security deposit when I moved in back in July of 2007. Is there anything I can do in an attempt to get my security deposit back? Open Question: I entered into a contract with a Real Estate Broker in April of 2007.?

According to the contract, he would pay the monthly mortgage & sell the property by end of August 2007. He said he already had a buyer & that he had a tenant who was going to move into the property & pay monthly rent. The Section 8 tenant moved in June 2007 & he was collecting rent monthly. When I hadn't heard form in by August's end, I made attempts to contact him which were futile. I was in Florida at the time. By year end, I returned to Illinois & chased him down only to hear that the buyer had backed out of the deal & he supposedly was trying to find another. I also found out he was not paying the mortgage regularly or on time, consequently accrueing late fees. And me being bombarded with daily messages from the lender, for non payment because my name is still on the mortgage. Unfortunately at the onset of all this, I signed a quit claim deed to the buyer(the one who backed out) only becuase I believed the was a done deal. So now I need to know what are my rights? If she backed out of the deal is this QCD null & void & can I sue The Broker for not honoring the contract? He has had numerous excuses for the last2 yrs. I now believe his intention was to collect montly rent for as long as possible while only paying the mortgage sporadically. The lender is pretty close to starting foreclosure but has not yet. All this is affecting my Credit rating as well as causing me extreme anxiety. WHAT CAN I DO? Any good advise will be appreciated.I truely appreciate the advise I've received thus far but no one has told me what happens to the Quit Claim Deed if the buyer who signed it with me backs out. Does she own the property even though she changed her mind & backed out of the deal? Is there anyone with any real estate knowledge who can answer this question? more

Here is what is going on, me and my gf are looking to buy a home. We are first time home buyers and are looking to buy a house or condo. We have placed bids on about 8 places so far. We started out bidding under the asking price and soon learned that would not be even considered. So we keeped over bidding more and more. Our price rang is $80k and under. The last place we looked at was a condo listed at $59,900 so we bid $74,000 asking for nothing back. So we bid $14k over asking. It was a foreclosure as is everything else we are looking at. We are not even bothering with short sales as we hear it will take forever and chances are very low you will get it. We are getting very discouraged and seems we will never get anything. We are looking in Bonita Springs and Naples, Florida. If anyone has any info that may help it would be great. Thanks! more

Resolved Question: Deciding to finish school and what direction to take..?

I am 22, have 60 college credits completed on an Economics major from FSU, I just moved to NY for my husband's job and I have been considering going to the NY school of interior design, as I really take a liking to the field. I worked for AIG while going to school previously and even though the pay is good, it doesn't excite me. Now though, I feel as if I'm at a crossroads transferring. Design school would take another 3 plus years and cost about 20k a year, Econ would take a year and half to finish and be better pay and cost less. I am currently starting a design e-business and take care of my two year old son. Should I finish Econ degree then go to design school or transfer now to design school and pursue the field? My parents pressure a lot to finish economics, my husband has no opinion either way, wants me to do what I want as he did marketing and is an advertising exec, but secretly hates it and wishes he did graphic design, but that pay is low. Long term goals would to own a design/furnishing company and acquire real estate. I also have my Florida Real Estate License. Any input from professionals of both fields or business owners would be appreciated. My father is a business owner with an MBA and continually reminds me I have all the time in the world, but I feel I need to get the ball rolling in the right direction, just trying to figure out which direction would be most career effective and cost efficient.I left out that- instead of a BS in Econ the interior design school would grant an BFA in Design... When I pass, even though the bonds and bond holders are not named specifically in my Will as assets, (but already named on the bond) are the bond recipients protected from any possible probate or heir contestment issues? I have no real estate or any other payments/annuities to divvy, all that has to be disbursed are my personal items, my car, any immediate cash in my bank, (which are in my Will) and the bonds that are pre named. I just want to make sure the bond recipients can cash and receive their bonds w/o any problems from any relatives possibly contesting them, if someone were to do so. more

I NEED HELP. My husband messed up when he was young, because his mother was a drug addict and alcoholic who had him dealing before high school and taking the blame for her. He has since met me and found out what a family, morals, and living like a real person and is doing his best to do that. My father passed away last year leaving his pride gun collection(trap and hunting) he was a competion trap shooter and an expert marksman, we lived in rural Indiana and if anyone in the area had problems like coyotes they called my dad to take care of it, we were a tight community and did not even have to lock doors! My mom moved to Florida and I went with her. When my dad died we have to settle the estate, I called and asked about the gun collection and they told me we should split them up for safety and there was no problem with having them in my home. I actually used to work for the local sheriff's department have never gotten into trouble in my life. I called several agencies all telling me the same thing, no problem. Then my mother in law(did I mention hates me and does not believe in god) got mad when my husband told her he had went to church several times and she needed to quit pushing him about me that he loved me and I was his life and if she did not like it then he would have to quit speaking to her. This woman is very convincing to everyone and nobody knows the real her, she has hired people to harrass me and threatened to make sure I had an accident and nobody would know that she had anything to do with me dying!!! She called the local police and told them he was in the house with loaded guns and was going to kill himself and them. HE DOES NOT AND WILL NOT TOUCH guns of any kind. But they broke in my house and found a gun that I had loaded because he was not home and I heard a noise. The same day a man shot local police officer right down the street so they are trying to charge him for possession of a firearm by a felon. I had asked if he could be in the house with them and they told me that they were mine and it would be against the 2nd admendment to tell me I could not! The problem is they need to make an example and I lost my job and can not afford an attorney and the local defenders office and does not seem to be helping! He is guilty of nothing for once in his life he was trying to do the right thing with his life and they are trying to give him 30 years. I need help, I am pregnant out of work and need my husband I am going to lose everything, who did nothing and can't find any help. He has been in there since March for nothing! We are in Volusia County Florida, anybody know anywhere to turn? more

Several attorneys gave mixed answers about the creditors, will my creditors give my executor an opportunity to carry on and pay my bills off ? Is this true ? In Florida, you can make a living trust to avoid probate for virtually any asset you own -- real estate, bank accounts, vehicles, and so on. You need to create a trust document (it’s similar to a will), naming someone to take over as trustee after your death (called a successor trustee). Then -- and this is crucial -- you must transfer ownership of your property to yourself as the trustee of the trust. Once all that’s done, the property will be controlled by the terms of the trust. At your death, your successor trustee will be able to transfer it to the trust beneficiaries without probate court proceedingsI have asked several times this same question, and it seems to be nobody has any real legal knowledge of Florida's probate fees and simple procedures. The county I live in has been accused of charging unauthorized fees and other things against people, it is also been stated to me by several attorneys that an attorney has to be retained out of the estate under Florida law. The Fla. bar said no but if retained an attorney can charge a maximum fee even if court appointed, that's why I did a Will to aviod the estate to have to be liquidated via probate. more

Me and my husband are approved for an FHA loan. We live in Florida. Just learning that FHA does not cover condos?? That rules out 50% of houses we can look at. My Mother has a brother who owns a home in central Florida which is paid off, and my mother wishes to have the deed to this home because her brother and his wife are ailing and need to go into an assisted living environment. Resolved Question: Why doesn't our brand new central air work?

Three weeks ago we moved into a house that we bought in Florida. It was built 2 years ago and we are the first people to live here. The building inspector reported that the central air was not blowing out cool air. We were told by the real estate agent that it likely just needed freon. After moving it we called a local HVAC company to have them check over and service the central air and they agreed it just needed freon, which they added. Since we are using our garage for storage of items for our home-based business we also had them install a vent in the garage to prevent the items from getting moldy. After they left the air worked no better than before they came, in other words it was on constantly and the house temp did not drop below 85 degrees. They came back a second time and found that there was no freon left in the system. It seems the original installers did a poor job soldering which caused the leak. So they resoldered, left and again the house temp would not go below 85 degrees. They came back a third time today and installed something called an 'expansion valve'. The house cooled to about 81 in the afternoon and it never shut off and then in the evening it cooled to the 78 (that we set the thermostat to, as a test) and it finally stopped running constantly. What's wrong? Why can't we cool this house to something like 72 degrees? Was it a mistake to have them put the vent in the garage where it is closest to the unit and may be sending the strongest, coolest air in the hot garage? Should they have warned us? Was there a better way to install a vent in the garage, say connecting the vent to a point farther away from the unit? Man, it's been a miserable, dreadful, sweaty 3 weeks in our new house. It's been hot day and night and now we are worried that our central air may not be able to cool this house. Can anyone offer advice on what we should do? The HVAC company says they do not know why our central air doesn't cool the house and they are out of ideas. We are miserable here. more

do you need to write up and have both parties sign a whole brand new contract or can you just add an addendum or something? Basically a couple is under contract for a house, then the female found out she had an issue on her credit report, so she cannont be on the loan. So then the male from the couple and his dad are going to be on the loan. So then do we have to do the whole contract over and have the dad and the guy sign and initial everything? It seems like everyone I know is talking about buying a home lately. I don't feel that I am where I want to be financially, but I'm hearing that housing prices are low and that by next year they will be back up again. I'm just looking for some realistic expectations. I live in Florida. My wife and I signed a lease for March 1 2009 thu Feb 1 2010 for the house we are living in. We gave the owner first, last and security deposit of one months rent. A process server came to our door on April 13 with a notice (lis penden) that a foreclosure action has been taken on the owner of the property. I asked the server how long do I have before the property is foreclosed and I have to find a new place. He told me that the minimum would be 90 days and it usually takes a year or so. The plaintiff listed on the action would not discuss anything with me on the grounds that they could not give legal advice. I need to know both the timeline by statute as well as a realistic timeline given the real estate market so that I know when I will need to find a new place. We really do want to stay in the place but not at the risk of being forced out on short notice or losing our rent money. more

Okay, I am interested in taking classes. How long do they take? I talked to a woman and they were going to give a 400 dollar scholarship away for a program here in NY. Well, I am asking because I thinking about moving away. I want to get into real estate, but I hear its really good in Florida right now. I want to take my classes where I would sell houses, because you have to have a license in the particular state you want to sell in. Any thoughts on this? Should I move to pursue real estate? I am in my early 20s, 3yrs of college- but I am not in college right now. Always wanted to do and I could save up and go back to school. And after I'm done I can work on being a broker or doing something like that. (went to school for Business) Any thoughts? Suggestions? Any other places I should look at? Resolved Question: Real Estate Appraiser - Verify Repairs?

This is not a new construction nor a FHA-insured loan. I am trying to purchase a foreclosure in Florida and my bank required repairs made that were noted on a home inspection report. I had 5 licensed contractors come in and do the required repairs (electrical, AC, windows and doors, etc.) ... all minor, maintenance, per the contractors (none noted that any impaired the safety, sanitation or structural soundness of the dwelling). I even had an architect look for structural integrity issues for my own peace of mind (architect opinion allowed under Florida Law). I had each licensed contractor sign the home inspection report next to each repair that applied to them and I have their itemized bills / invoices which state repairs made per inspection report or inspector. Last week the appraiser came out to the property without anyone's knowledge; and therefore, did not go over the inspection report. He said he would only look at what he noted on his original appraisal (items which were not required to be repaired by the bank). The bank order the appraiser again to came back to the house and again specifically order the re-inspection according to the home inspection report. Now another week has gone by. Time is of the essence and I am paying 100.00 per day to the seller for this delay up until the day of closing because I have asked for 3 extensions, so far it has cost me 700.00 for this delay and will cost me another 1,400.00. I also had to sign an extension including that my 2,000 earnest money is now be non-refundable. If do not close in 1 week, I will lose the house and the money I have paid for the repairs (all contractors came in less than 24-hours notice and finished in 4 days). How is the appraiser to verify that the repairs have been done? He will do a walk-through I assume. Some things are visual, but others are not. Can he use my copy of the home inspection report signed off by the contractors and their itemized invoices? Crazy, I know. But the banks are making it extremely had to purchase a REO / Foreclosure. I know you are saying, just get another house. I really want this house, I am getting it for a great price and it is a great investment. I looked at 22 other houses and this one is in great condition for a foreclosure. I agreed to do the repairs because I would have done them anyway. Besides I was 6 weeks into the deal when the bank made the demand for the repairs. This appraiser took 3 weeks to come out and do the first initial appraisal. And I do now have an attorney to file suit if I do not close. This is in part "the principal" ... big banks beating up the hard working little girl or guy.
